In consideration of being permitted to participate in any way in Backyard Pilates LLC programs,I, for myself, my heirs, personal representatives or assigns, do hereby release, waive,discharge, and covenant not to sue Backyard Pilates LLC from liability from any and all claims resulting in personal injury, accidents, or illnesses (including death), and property loss arising from, but not limited to participation in Backyard Pilates LLC programs.
I also agree to INDEMNIFY AND HOLD Backyard Pilates LLC and their officers, employees,volunteers and agents HARMLESS from any and all claims, actions, suits, procedures, costs,expenses, damages and liability, including attorneys’ fees brought as a result of my participation in Backyard Pilates LLC programs and to reimburse Backyard Pilates LLC for any such expense incurred. I specifically agree to indemnify and hold harmless Backyard Pilates LLC as to any loss, cost, claim, injury, damage or liability, sustained or incurred by participating in Backyard Pilates LLC programs, which is caused by an act or omission, whether negligent, intentional or
otherwise, of an officer, employee, volunteer or agent of Backyard Pilates LLC.
The undersigned expressly agrees that this Waiver and Assumptions of Risk Agreement shall be interpreted under and construed in accordance with the laws of the State of Maryland, without the benefit of and fully disregarding all conflicts of laws or provisions of the State of Maryland,so that any and all disputes arising from or related to this release Waiver and Assumption of
Risks Agreement or my participation in any and all Backyard Pilates LLC programs shall be interpreted under and in accordance with only the laws of the State of Maryland and that the only court in which an action or suit may be brought in connection with the foregoing shall be in the court of original jurisdiction of the State of Maryland.
I further expressly agree that the foregoing waiver and assumption of risks agreement is intended to be as broad and inclusive as permitted by law of the State of Maryland that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
I hereby acknowledge and understand that participating in Backyard Pilates LLC programs involves physical activity and that I have been advised to consult a physician before commencing and undertaking such activity.
I have read this Waiver and Assumption of Risks Agreement, fully understand its terms, and understand that by my initial below, I forfeit substantial rights, including the right to seek relief in the court of law. I acknowledge that I am signing the agreement freely and voluntarily, and by my initial, intend for this Waiver and Assumption of Risks Agreement to be a complete and unconditional release of all liability to the greatest extent allowed by law.
I represent that I am at least 18 years of age, have read and understand the foregoing statements, and am competent to execute this agreement.
